What Is a Will Used For?

A legally valid Will can set out:

  • who should inherit your estate,
  • who should act as executor,
  • how specific gifts are dealt with, and
  • other instructions permitted by law.

For a Will to be valid, it must meet strict legal requirements, including rules about signing and witnessing the document correctly.

Why Do People Make Wills?

People commonly make Wills to:

  • decide who should benefit from their estate,
  • reduce uncertainty for family members,
  • appoint people they trust to deal with matters, and
  • avoid the estate being distributed under intestacy rules.

If there is no valid Will, the law decides who inherits, regardless of personal wishes.

Executors of a Will: Duties and Responsibilities

Executors are responsible for dealing with the estate after death. This can involve:

  • identifying assets and debts,
  • applying for probate if required,
  • paying liabilities, and
  • distributing the estate.

These responsibilities arise automatically by law and can involve personal liability. Read our guide on Executor duties and responsibilities.

Changing Or Updating a Will?

A Will can usually be updated or amended during your lifetime. Certain life events can affect how a Will operates and, in some cases, whether it remains valid.

How MJV Solicitors Can Help

When instructed to prepare a Will, we:

  • explain the legal position in plain terms,

Frequently Asked Questions

1What happens if someone dies without a Will?
If there is no valid Will, your estate is distributed according to intestacy rules set out in legislation. These rules may not reflect personal wishes, and the process of distributing assets under these circumstances can be much more stressful for those left behind. Read our guide, ‘What Happens When Someone Dies Without a Will?’, for more information on this topic.
2Does a Will cover property and savings?
Yes. A Will can deal with property, savings, investments and personal possessions.
3Is a Will legally binding?
A Will that is properly executed is legally binding, subject to limited statutory exceptions. However, it is recommended that you seek regulated professional guidance to ensure that the Will meets all the legal requirements.
4Can a Will be challenged?
In some circumstances, the contents of a Will can be challenged, for example, by arguing that it is invalid under the Wills Act 1837. Each case depends on its facts and there are only certain circumstances over which a Will can be disputed. Simply disagreeing with its contents is not, on its own, sufficient grounds to challenge it.
5What is the Inheritance Act 1975?
If someone believes they are not properly provided for in the Will, or through the rules of intestacy, the Inheritance (Provision for Family and Dependants) Act 1975 gives certain individuals the legal right to claim reasonable financial provision from the estate of someone who has died. However, there are strict rules surrounding who can make a claim, so seeking specialist legal advice is essential.
