Leaseholder Wins £16,800 Compensation Over Damp, Leaks, and Failed Repairs

12 December 2025

Case Study Overview: Structural Defects Left Untreated for Years – Until MJV Solicitors Took Action

Our clients, Mr and Mrs Y, long leaseholders of a flat in a five-storey block in North London, had been battling building disrepair for over four years. Despite paying service charges, their complaints were ignored by the freeholder, Network Homes.

When they instructed our specialist leasehold disrepair solicitors, the situation changed, fast, with our expert help.

The Problems They Faced

Due to the persistent, untreated issues, the couple’s home suffered from:

  • Persistent damp and water damage in a bedroom and around the balcony doors
  • Defective drainage on their balcony
  • Ongoing cold and wet conditions affecting their comfort and health

Although our clients reported the problems multiple times, Network Homes proposed cheap, temporary repairs that had already failed in other flats in the block.

Frustrated and fed up with these failings, they turned to us for legal help.

How MJV Solicitors Helped

After contacting our team for help, our specialist housing disrepair team:

  • Reviewed the lease to confirm the landlord’s obligations
  • Gathered photographic and written evidence
  • Jointly instructed a qualified building expert with the freeholder
  • Issued a formal Letter Before Action under the Pre-Action Protocol
  • Negotiated a financial and repair settlement before court action was necessary

The Result for Our Clients

As a result of our assistance:

  • The landlord agreed to complete all necessary repairs
  • Our clients received £16,800 in compensation
  • We acted under a no win, no fee agreement — they paid nothing upfront

This outcome gave them peace of mind, fair compensation, and finally, the repairs they had been waiting years to receive.

Client Feedback – What Our Clients Said

“We requested MJV Solicitors’ help after years of issues with our housing association disrepair. After a few years, we finally got the repairs done and compensation.
Thanks so much Michael for all your amazing help.”

Re-mortgages

We charge £500 plus VAT for acting on a re-mortgage.

Our disbursements are limited to the Land Registry searches of £3 per document (there is no VAT on Land Registry charges) and typically the total cost of these is between £6-£15 depending on how many documents are registered and whether the property being re-mortgaged is freehold or leasehold. Most lenders normally permit the purchase of no search insurance rather than undertaking new searches and this costs, inclusive of insurance premium tax.
