Buying vs Selling. What’s the Difference?
We handle residential conveyancing transactions on a daily basis, including freehold, leasehold and new build properties across the Fylde Coast.
Conveyancing differs depending on whether you are buying or selling a property. While both involve legal documentation and contracts, the solicitor’s role and focus are different.
When selling, the focus is on preparing the legal documentation and providing accurate information about the property. Sellers are expected to answer the relevant property information forms truthfully, completely and as accurately as they can from their own knowledge. This can include information about disputes, alterations, boundaries, notices and other matters affecting the property. Misleading information can lead to problems or claims after completion.
When buying, the focus is on investigation. The buyer’s solicitor reviews the title and contract, considers the results of property searches, raises enquiries and identifies legal risks before contracts are exchanged. This helps protect the buyer from legal or financial problems that may not be obvious from viewing the property.
At MJV Solicitors, both buyers and sellers are advised with the same objective: a smooth transaction and proper legal protection. Understanding the different responsibilities on each side helps reduce the risk of disputes and avoidable delay.
Buying and selling may appear similar, but the legal work is different. Sellers need to provide accurate information about the property, while buyers need proper investigation of the title, searches and enquiries before they become legally committed.
Many buyers assume a property is simply bought as seen. In reality, legal title, rights of way, restrictive covenants and other legal rights or restrictions may not be visible during a viewing.
