The Two Types of LPA
A property and financial affairs LPA allows an attorney to manage financial matters on your behalf. This includes bank accounts, bills, investments, pensions, and property. It can be used with your consent while you still have capacity, or automatically if capacity is lost.
A health and welfare LPA covers decisions about your personal care, medical treatment, and day-to-day living arrangements. It can only be used if you are unable to make decisions yourself. It does not give an attorney authority over financial matters.
Without the correct type of LPA in place, family members may not have the authority to deal with specific issues if capacity is lost - even if another type of LPA exists. In practice, most people choose to put both in place to ensure full coverage.
